Xenex Enterprises Inc. (“XEI”) and www.signaturemaster.com (“SM”) acknowledge the importance of how information about our clients is used and shared. We appreciate your trust that we will do so carefully and sensibly.
Please note that Xenex Enterprises Inc. (“XEI”) owns and operates SignatureMaster™ and SM web site. If you have an account on SM, information entered by you and gathered by SM, may be correlated with any personally identifiable information that XEI and SM have and will be used by SM and XEI to improve the services we offer to you.
This describes our privacy policy. By visiting www.signaturemaster.com, you are accepting the practices described in this Privacy Statement.
PERSONAL INFORMATION ABOUT SM CUSTOMERS
INFORMATION YOU ENTER IN SM: We store any information you enter on our SM Web site or give us in any other means. You may choose not to provide certain information, which might result in not being able to take advantage of many features of SM. We use the information that you provide for the purposes of responding to your requests, customizing future deliverables for you needs, improving our SM solution, and communicating with you.
AUTOMATIC INFORMATION: We receive and store certain types of information whenever you enter the SM Web Site. For example, we may obtain certain types of information when your Web browser accesses SM and other content served by or on behalf of SM for the verification audit trail which is shared with anyone requesting document authentication. Like many Web sites, we may use temporary "cookies" to retain certain data required for the transfer between SM pages.
E-MAIL COMMUNICATIONS: To help us make certain e-mails to allow you access to the SM system, we often receive a confirmation when you click a button or link on your e-mail from SM if your computer supports such capabilities. We also compare our customer information with information received from other companies from which you wish to do business. In an effort to establish a working relationship with another company you may receive an email invitation to join another working group. If you do not want to receive e-mail or other mail from us or companies you established a working relationship in SM, our ability to provide our services might be compromised or abolished.
INFORMATION FROM OTHER SOURCES: We might receive information about you from other sources you have established a working relationship in SM and add it to our account information.
COOKIES
- Cookies are unique identifiers that we transfer to your device to enable our systems to recognize your device and to provide features such as, personalized user interface and seamless navigation throughout the SM Web sites, and session tracking.
- The Help feature on most browsers will tell you how to prevent your browser from accepting new cookies, how to have the browser notify you when you receive a new cookie, or how to disable cookies altogether. Additionally, you can disable or delete similar data used by browser add-ons, such as Flash cookies, by changing the add-on's settings or visiting the Web site of its manufacturer. Because cookies allow you to take advantage of some of SM's essential features, we recommend that you leave them turned on. For instance, if you block or otherwise reject our cookies, you will not be able to use any SM products and services that require you to Sign in.
SHARING OF INFORMATION RECEIVED
Information about our customers is an important part of our process, and we are not in the business of selling it to others. We share customer information only as described below and with controls that either are subject to this Privacy Statement or follow practices at least as protective as those described in this Privacy Statement.
- PARTNER BUSINESSES WE DO NOT CONTROL: We work closely with companies you have established a business relationships. In some cases, these businesses may invite you and in other cases, you may invite them within SM to be part of a working group or sign and seal electronic documents. Or other organisation users may request the verification of the authenticity of documents signed and sealed by you. You can tell when the other parties are involved in your signing and sealing transaction by reviewing the room participants list in the SN ‘Signature Room’. We also share customer information related to the signing and sealing transactions with any party that wishes to verify the authenticity of the document signed and sealed by you.
- THIRD-PARTY SERVICE PROVIDERS: We employ other companies and individuals to perform functions on our behalf. Examples include data centers, email, postal mail and e-mail service providers, removing repetitive information in SM, analyzing data, providing marketing assistance, providing search results and links (including paid listings and links), processing credit card and other electronic payments, and providing customer service. They may have access to personal information needed to perform their functions, but may not use it for other purposes.
- PROMOTIONAL OFFERS: Sometimes we send offers to selected groups of SM customers on behalf of our businesses. If you do not want to receive such offers, please contact us to remove you from any marketing communication.
- BUSINESS TRANSFERS: As we continue to develop our business, we might sell or buy subsidiaries, or business units. In such transactions, customer information generally is one of the transferred business assets but remains subject to the promises made in any pre-existing Privacy Statement (unless, of course, the customer consents otherwise). Also, in the unlikely event that SM, or substantially all of its assets are acquired, customer information will of course be one of the transferred assets.
- PROTECTION OF SM AND OTHERS: We release account and other personal information when we believe release is appropriate to comply with the law; enforce or apply our Terms of Use and other agreements; or protect the rights, property, or safety of SM, our users, or others. This includes exchanging information with other companies and organizations for fraud protection and credit risk reduction. Obviously, however, this does not include selling, renting, sharing, or otherwise disclosing personally identifiable information from customers for commercial purposes in violation of the commitments set forth in this Privacy Statement.
- WITH YOUR CONSENT: Other than as set out above, you will receive notice when information about you might go to third parties, and you will have an opportunity to choose not to share the information.
INFORMATION SECURITY
- We work to protect the security of your information during transmission by using Secure Sockets Layer (SSL) software, which encrypts information you input.
- If payments are made by credit card, we may reveal only the last four digits of your credit card numbers when confirming an order. Of course, we may transmit the entire credit card number to the appropriate credit card processing company during order processing.
- It is important for you to protect against unauthorized access to your password, your Personal Identification Number (PIN) and to your computer. You agree that sharing your password or PIN with a third-party shall be deemed to have given them your Power of Attorney (POA) authorizing them to sign or seal documents on your behalf as your Attorney-In-Fact (AIF). Be sure to sign off when finished using a shared computer.
LINKS TO OTHER WEBSITES AND ADVERTISING
Our site may include third-party logos or advertising and links to other Web sites. For more information about third-party advertising at SM, please contact us.
ACCESS TO INFORMATION
SM gives you access to information about your account and your interactions with SM for the limited purpose of viewing and updating that information your information and in case of the ‘Signature Room’ to view the other room participants’ information. The list of which will change as the SM Web site evolves.
CHOICES AND OPTIONS
- As discussed above, you can always choose not to provide information, even though it might be needed for key functionalities or to take advantage of such SM features as Your or Your company profiles, your credentials and your working group relationships.
- You can add or update certain information on pages such as those referencing your personal or company information. When you update information, we may keep a copy of the prior version for our records for audit trail purposes.
- If you do not want to receive e-mail or other mail from SM or XEI, please contact us and provided it does not impact our ability to provide the SM services, we will refrain from sending e-mail or other mail from us. (If you do not want to receive Terms of Use and other legal notices from us, such as this Privacy Statement, those notices will still govern your use of SM, and it is your responsibility to review them for changes.)
- If you do not want us to use personal information that we gather to allow your work group or third parties to personalize logos or advertisements we may display to you, please contact us.

SM does not offer products or services for purchase to children. If you are under 18, you may use SM only with the involvement of a parent or guardian.
CONDITIONS OF USE, NOTICES, AND REVISIONS
If you choose to visit SM and it sites, your visit and any dispute over privacy is subject to this Notice and our Terms of Use, including limitations on damages, resolution of disputes, and application of the law of Ontario, Canada. If you have any concern about privacy at SM, please contact us with a thorough description, and we will try to resolve it. Our business changes constantly, and our Privacy Statement and the Terms of Use will change also. We may request periodically that you re-accept them before you can use the system, but you should check our Web site frequently to see recent changes. Unless stated otherwise, our current Privacy Statement applies to all information that we have about you and your account. We stand behind the promises we make, and will never materially change our policies and practices to make them less protective of customer information collected in the past without the consent of affected customers.
EXAMPLES OF INFORMATION COLLECTED
INFORMATION YOU GIVE US
You provide most such information when you buy, post, participate in a transaction or communicate with our customer service. For example, you provide information when you register; you become a participant in a SM transaction or are invited to become part of a third party workgroup; provide information in Your Account (and you might have more than one if you have used more than one e-mail address when registering with us) or Your Profile; communicate with us by phone, e-mail, or otherwise; complete a questionnaire or a contest entry form; use our services such as opening rooms; sign or seal documents; participate in User Group discussions or other user community features; provide and rate reviews; and employ Products that are offered on Beta testing environments. As a result of those actions, you might supply us with such information as your name, address, and phone numbers; credit card information; people or organization that you developed business relationships, including addresses and phone number; people (with addresses and phone numbers); e-mail addresses of your friends, colleagues and other people; content of reviews and e-mails to us; personal description and photograph in Your Profile ; and financial information, including Social Security and driver's license numbers.
AUTOMATIC INFORMATION
Examples of the information we may collect and analyze include the Internet protocol (IP) address used to connect your computer to the Internet; login; e-mail address; password; computer and connection information such as browser type, version, and time zone setting, browser plug-in types and versions, operating system, and platform; purchase history, which we sometimes aggregate with similar information from other customers to create new features or products; the full Uniform Resource Locator (URL) from our Web site, including date and time; cookie number; products you viewed or searched for; and the phone number you used to call our toll free telephone number. We may also use browser data such as cookies, or similar data on certain parts of our Web site for fraud prevention and other purposes. During some visits we may use software tools such as JavaScript to measure and collect session information, including page response times, download errors, length of visits to certain pages, page interaction information (such as scrolling, clicks, and mouse-overs), and methods used to browse away from the page. We may also collect technical information to help us identify your device for fraud prevention and diagnostic purposes.
MOBILE
Most mobile devices provide users with the ability to disable location services. Most likely, these controls are located in the device's settings menu. If you have questions about how to disable your device's location services, we recommend you contact your mobile service carrier or your device manufacturer.
INFORMATION FROM OTHER SOURCES
Examples of information we receive from other sources include updated delivery and address information from your workgroup partners or other third parties, which we use to correct our records and deliver services or communicate with your organization or you more easily; account information, purchase or service information, including service payments; and credit history information from credit bureaus, which we use to help detect and prevent fraud and to offer certain credit or financial transaction services.
INFORMATION YOU CAN ACCESS
Examples of information you can access easily at SM include up-to-date information regarding recent transactions; personally identifiable information (including name, e-mail, password, communications and personalized advertising preferences, and address information); payment settings (including credit card information and promotional certificate and pre-payment balances); e-mail notification settings (including invitations to sign or seal, and to join a working group); and Your Profile (including your signed and seal documents, date reminders, personal profile, and working group relationships).
RECITALS
The term “Personal Information” is defined in the applicable legislation. Personal Information is collected by SignatureMaster™ and its parent company, Xenex Enterprises Inc. (collectively “XENEX”), for the purposes of: enabling the use of the SignatureMaster™ application (by invited authorized parties) for signing; sealing and verifying documents; enabling the confirmation (by parties authorized to view documents within SignatureMaster™) of the authenticity of signatures and seals applied to documents; sharing with parties as approved by the owner of the Personal Information and responding to authorized requests related to information audits and legislative requirements. In addition, where our SignatureMaster™ products are involved, we use Personal Information as an integral part of an ongoing process of maintenance of our SignatureMaster™ accounts, including but not limited to: considering, establishing and maintaining a SignatureMaster™ user profile; assessing the online use of the application as it relates to performance and pricing policies and execution; investigating, evaluating and handling potential system security breach claims; recovering losses under indemnities and guarantees provided in support of SignatureMaster™ profile guarantees. In using Personal information for these purposes XENEX sometimes discloses personal information to: XENEX employees directly involved in handling SignatureMaster™ business and those responsible for corporate governance, regulators and auditors, courts of law, legal counsel retained to advise or assist XENEX with respect to SignatureMaster™ matters, and companies related to XENEX.
Xenex will retain Personal Information within SignatureMaster™ for the same period of time it is requested by SignatureMaster™ customers to retain the documents containing the Personal information.
